Terms of Service

Welcome to The Inmost ("The Inmost," "we," "our," or "us"). By accessing or using our website at theinmost.com, mobile applications, or related services (collectively, the "Service"), you ("User," "you") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Nature of the Service (Not Medical or Psychological Advice)

1.1 Educational and coaching purposes only:The Inmost is a technology platform for relationship coaching, communication strategies, and behavioral guidance (including "Daily Sparks" and community features). It is not therapy, medical care, or psychiatric treatment.

1.2 Not a substitute for professional help: We do not diagnose or treat mental health conditions. Content from the Service — including AI-generated or human-reviewed material — is for general informational and coaching purposes only.

1.3 Crisis warning: If you are in immediate danger, experiencing abuse, or having thoughts of self-harm, stop using the Service and contact local emergency services or a qualified professional. We are not responsible for crisis intervention.

2. AI and Human-in-the-Loop (HITL)

2.1 AI-generated content: The Service uses artificial intelligence to analyze your inputs and generate suggestions. AI may produce inaccurate or inappropriate content. Use your own judgment before acting on any suggestion.

2.2 Human review: For certain features (including the Sanctuary vault and related submissions), authorized personnel bound by confidentiality may review encrypted content to calibrate responses before delivery to you. See our Privacy Policy for details.

2.3 Your responsibility: You are solely responsible for how you act on Sparks, prompts, or advice from the Service. We are not liable for real-world relationship outcomes.

3. Free and Premium access

3.1 Free tier: After registration, you may use limited features at no charge, including Daily Sparks and limited read-only access to the community feed (as described on our Pricing page). Free users cannot post, like, comment, view other members' profiles, initiate direct messages, or browse beyond the free feed limit without upgrading.

3.2 Premium: Premium unlocks full community and messaging features for a fixed period after a one-time payment. Current plans and prices are always listed on the Pricing page.

3.3 Feature changes: We may adjust free or Premium feature limits for product, safety, or legal reasons. Material changes to paid features will be communicated in advance where reasonably practicable.

4. Payments, billing, and Premium access

4.1 Pricing: Premium is sold as a one-time purchase in Indian Rupees (INR): ₹149 (7 days) and ₹399 (30 days). See Pricing for the current list.

4.2 Payment processor: Payments are processed by Razorpay. By paying, you also agree to Razorpay's applicable terms where relevant. We do not store your full payment card or UPI credentials.

4.3 No auto-renewal: Premium is not a recurring subscription. We will not automatically charge you when your access period ends. To continue Premium after expiry, you must purchase again.

4.4 Access period: Premium begins when payment is successfully confirmed and ends after the purchased period (7 or 30 days from activation, as shown in the app). We may revoke access immediately if a payment is reversed, refunded, or found to be fraudulent.

4.5 Taxes: Applicable taxes (including GST, where required) may be added at checkout as displayed before you confirm payment.

4.6 Refunds: Refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

5. Privacy and data

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including payment-related data handled through Razorpay.

6. Account eligibility and responsibilities

6.1 Age: You must be at least 18 years old to use the Service.

6.2 Account security: You are responsible for your login credentials and all activity under your account. Notify us promptly of unauthorized access at admin@theinmost.com.

6.3 Community conduct: You agree not to:
  • Harass, stalk, threaten, or abuse other users.
  • Post illegal, hateful, sexually exploitative, or non-consensual content.
  • Impersonate others or misrepresent your identity.
  • Reverse engineer, scrape, or attempt to extract source code, prompts, or models.
  • Upload malware, prompt injections, or other attempts to disrupt the Service.
  • Use the Service for commercial solicitation without our written permission.

6.4 Enforcement: We may suspend or terminate accounts that violate these Terms or harm other users, with or without refund, as permitted by law and our refund policy.

7. Intellectual property

The Service, including software, design, branding, and content we provide, is owned by The Inmost or its licensors. You receive a limited, personal, non-transferable license to use the Service while these Terms apply. You retain ownership of content you submit, but grant us a license to host, process, and display it as needed to operate the Service (including AI and HITL processing described in our Privacy Policy).

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR SPECIFIC RELATIONSHIP OUTCOMES.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INMOST AND ITS FOUNDERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING EMOTIONAL DISTRESS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR INR 1,000 IF YOU HAVE NOT PAID US, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.

10. Indemnification

You agree to indemnify and hold harmless The Inmost from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content or conduct on the Service, or your misuse of suggestions provided by the Service.

11. Governing law and disputes

11.1 Governing law: These Terms are governed by the laws of India, without regard to conflict of law principles.

11.2 Disputes: Subject to applicable consumer protection laws, you agree that courts located in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, unless mandatory law requires a different forum.

12. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. For material changes affecting paid features or billing, we will provide notice by email or in-app notification where practicable. Continued use after the effective date constitutes acceptance, except where applicable law requires your consent.
